4. Personal Data Protection
Personal Data Protection Act
The Personal Data Protection Department (JPDP) is an agency under the Ministry of Communications and Multimedia Malaysia (KKMM), established on 16 May 2011 following Parliament’s approval of the Personal Data Protection Act 2010 (PDPA), also known as Act 709.
The Department’s primary responsibility is to regulate the processing of individuals’ personal data involved in commercial transactions by Data Users, to prevent misuse or abuse by interested parties.
The security of users’ personal data must be protected to prevent any form of misuse in the storage or processing of personal data of individuals, whether public or private, in Malaysia within the scope of commercial transactions, as stipulated under the PDPA.
In enforcing the PDPA, JPDP requires all Personal Data User Groups, comprising individuals and private entities (excluding the Government), to register officially to safeguard the rights of users and the public.
JPDP is led by a Director General, assisted by a Deputy Director General, and consists of three main divisions:
